or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2993"},"content":[{"type":"text","text":"is occurring; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2994"},"content":[{"type":"text","text":"is imminent; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2995"},"content":[{"type":"text","text":"the incident has had, is having, or is likely to have, one or more relevant impacts on one or more critical infrastructure assets (each of which is a "},{"type":"text","text":"primary asset","marks":[{"type":"bold"},{"type":"italic"}]},{"type":"text","text":"); and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2996"},"content":[{"type":"text","text":"there is a material risk that the incident has seriously prejudiced, is seriously prejudicing, or is likely to seriously prejudice:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2997"},"content":[{"type":"text","text":"the social or economic stability of Australia or its people; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2998"},"content":[{"type":"text","text":"the defence of Australia; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2999"},"content":[{"type":"text","text":"national security; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3038"},"content":[{"type":"text","text":"the functioning of the asset or assets concerned; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3039"},"content":[{"type":"text","text":"the consequences of compliance with the specified direction; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3043"},"content":[{"type":"text","text":"requires the specified entity to take offensive cyber action against a person who is directly or indirectly responsible for the incident."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(9A)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3044"},"content":[{"type":"text","text":"Without limiting paragraph"},{"type":"text","text":" "},{"type":"text","text":"(2)(c) or (d), a direction referred to in that paragraph may require a specified entity to disclose specified personal information (within the meaning of the "},{"type":"text","text":"Privacy Act 1988","marks":[{"type":"italic"}]},{"type":"text","text":") held by the entity to another specified entity for a specified purpose."}]}]},{"type":"legalListItem","attrs":{"marker":"(9B)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3045"},"content":[{"type":"text","text":"However, the Minister must not give a Ministerial authorisation under paragraph"},{"type":"text","text":" "},{"type":"text","text":"(2)(c) or (d), to the extent that it authorises the giving of a direction covered by subsection"},{"type":"text","text":" "},{"type":"text","text":"(9A), unless the Minister has obtained the agreement of the Minister administering the "},{"type":"text","text":"Privacy Act 1988","marks":[{"type":"italic"}]},{"type":"text","text":"."}]}]}]},{"type":"heading","attrs":{"id":"v0-p-3046","level":6},"content":[{"type":"text","text":"Intervention requests","marks":[{"type":"italic"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(10)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3047"},"content":[{"type":"text","text":"The Minister must not give a Ministerial authorisation under paragraph"},{"type":"text","text":" "},{"type":"text","text":"(2)(e) or (f) that relates to the incident and an asset unless the Minister is satisfied that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(aa)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3048"},"content":[{"type":"text","text":"the incident is a cyber security incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3049"},"content":[{"type":"text","text":"giving a Ministerial authorisation under paragraph"},{"type":"text","text":" "},{"type":"text","text":"(2)(c) or (d) would not amount to a practical and effective response to the incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3050"},"content":[{"type":"text","text":"if there is only one relevant entity for the asset—the relevant entity is unwilling or unable to take all reasonable steps to respond to the incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3051"},"content":[{"type":"text","text":"if there are 2 or more relevant entities for the asset—those entities, when considered together, are unwilling or unable to take all reasonable steps to respond to the incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3052"},"content":[{"type":"text","text":"the specified request is reasonably necessary for the purposes of responding to the incident;
