{"type":"doc","content":[{"type":"section","attrs":{"id":"navPoint_177"},"content":[{"type":"heading","attrs":{"id":"v0-p-3176","level":5},"content":[{"type":"text","text":"35AF","marks":[{"type":"bold"}]},{"type":"text","text":"  ","marks":[{"type":"bold"}]},{"type":"text","text":"Form of application for Ministerial authorisation","marks":[{"type":"bold"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(1)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3177"},"content":[{"type":"text","text":"The Secretary may apply for a Ministerial authorisation either:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3178"},"content":[{"type":"text","text":"orally; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3179"},"content":[{"type":"text","text":"in writing."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3180"},"content":[{"type":"text","text":"The Secretary must not apply orally for a Ministerial authorisation that relates to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3181"},"content":[{"type":"text","text":"an incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3182"},"content":[{"type":"text","text":"an asset;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3183"},"content":[{"type":"text","text":"unless the delay that would occur if the application were to be made in writing would frustrate the effectiveness of:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3184"},"content":[{"type":"text","text":"any directions that may be given under section"},{"type":"text","text":" "},{"type":"text","text":"35AK or 35AQ in relation to the incident and the asset; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3185"},"content":[{"type":"text","text":"any requests that may be given under section"},{"type":"text","text":" "},{"type":"text","text":"35AX in relation to the incident and the asset."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3186"},"content":[{"type":"text","text":"If an application for a Ministerial authorisation is made orally, the Secretary must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3187"},"content":[{"type":"text","text":"do both of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3188"},"content":[{"type":"text","text":"make a written record of the application;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3189"},"content":[{"type":"text","text":"give a copy of the written record of the application to the Minister; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3190"},"content":[{"type":"text","text":"do so within 48 hours after the application is made."}]}]}]}]}]}]}]}
