and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3877"},"content":[{"type":"text","text":"the asset relates to a critical infrastructure sector; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3878"},"content":[{"type":"text","text":"the Minister is satisfied that the asset is critical to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3879"},"content":[{"type":"text","text":"the social or economic stability of Australia or its people; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3880"},"content":[{"type":"text","text":"the defence of Australia; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3881"},"content":[{"type":"text","text":"national security; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3882"},"content":[{"type":"text","text":"there would be a risk to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3883"},"content":[{"type":"text","text":"the social or economic stability of Australia or its people; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3884"},"content":[{"type":"text","text":"the defence of Australia; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3885"},"content":[{"type":"text","text":"national security;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3886"},"content":[{"type":"text","text":" "},{"type":"text","text":" "},{"type":"text","text":"if it were publicly known that the asset is a critical infrastructure asset."}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3887"},"content":[{"type":"text","text":"Note:"},{"type":"text","text":" "},{"type":"text","text":"It is an offence to disclose the fact that an asset is declared to be a critical infrastructure asset (see section"},{"type":"text","text":" "},{"type":"text","text":"45)."}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3888"},"content":[{"type":"text","text":"The declaration must specify the entity that is the responsible entity for the asset."}]}]},{"type":"legalListItem","attrs":{"marker":"(2A)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3889"},"content":[{"type":"text","text":"The declaration may do any or all of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3890"},"content":[{"type":"text","text":"determine that Part"},{"type":"text","text":" "},{"type":"text","text":"2 applies to the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3891"},"content":[{"type":"text","text":"determine that Part"},{"type":"text","text":" "},{"type":"text","text":"2A applies to the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3892"},"content":[{"type":"text","text":"determine that Part"},{"type":"text","text":" "},{"type":"text","text":"2B applies to the asset."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3893"},"content":[{"type":"text","text":"The Minister must notify the following of the declaration, in writing, within 30 days after making the declaration:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3894"},"content":[{"type":"text","text":"each reporting entity for the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3895"},"content":[{"type":"text","text":"if the asset is a tangible asset located (wholly or partly) in a State, the Australian Capital Territory or the Northern Territory—the First Minister of the State, the Australian Capital Territory or the Northern Territory, as the case requires."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(5)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3896"},"content":[{"type":"text","text":"A declaration under subsection"},{"type":"text","text":" "},{"type":"text","text":"(1) is not a legislative instrument."}]}]}]}]}]}
