and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1950"},"content":[{"type":"text","text":"the entity had a critical infrastructure risk management program that applied to the entity."}]}]}]}]}]},{"type":"heading","attrs":{"id":"v0-p-1951","level":6},"content":[{"type":"text","text":"Annual report","marks":[{"type":"italic"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1952"},"content":[{"type":"text","text":"The entity must, within 90 days after the end of the financial year, give:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1953"},"content":[{"type":"text","text":"if there is a relevant Commonwealth regulator that has functions relating to the security of those assets—the relevant Commonwealth regulator; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1954"},"content":[{"type":"text","text":"in any other case—the Secretary;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-1955"},"content":[{"type":"text","text":"a report that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1956"},"content":[{"type":"text","text":"if the entity had the program at the end of the financial year—includes whichever of the following statements is applicable:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1957"},"content":[{"type":"text","text":"if the program was up to date at the end of the financial year—a statement to that effect;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1958"},"content":[{"type":"text","text":"if the program was not up to date at the end of the financial year—a statement to that effect; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1959"},"content":[{"type":"text","text":"if a hazard had a significant relevant impact on one or more of those assets during the relevant period—includes a statement that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1960"},"content":[{"type":"text","text":"identifies the hazard; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1961"},"content":[{"type":"text","text":"evaluates the effectiveness of the program in mitigating the significant relevant impact of the hazard on the assets concerned; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1962"},"content":[{"type":"text","text":"if the program was varied during the financial year as a result of the occurrence of the hazard—outlines the variation; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(da)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1963"},"content":[{"type":"text","text":"if one or more of those assets are critical telecommunications assets:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1964"},"content":[{"type":"text","text":"includes a summary of the changes (if any) the entity notified during the relevant period under subsection"},{"type":"text","text":" "},{"type":"text","text":"30EC(2); and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1965"},"content":[{"type":"text","text":"describes the risks (if any) advised to the entity during the relevant period under paragraph"},{"type":"text","text":" "},{"type":"text","text":"30ED(3)(c); and"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1966"},"content":[{"type":"text","text":"describes the measures (if any) the entity adopted during the relevant period to eliminate or reduce risks advised to the entity during the relevant period or any previous period; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(iv)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1967"},"content":[{"type":"text","text":"includes a statement that evaluates the effectiveness of those measures to eliminate or reduce risks advised to the entity during the relevant period or any previous period; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(db)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1968"},"content":[{"type":"text","text":"if the entity was given a direction under section"},{"type":"text","text":" "},{"type":"text","text":"30AI during the relevant period—includes a statement that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1969"},"content":[{"type":"text","text":"sets out the content of the direction; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1970"},"content":[{"type":"text","text":"sets out how the program was varied in response to the direction; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(e)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1971"},"content":[{"type":"text","text":"is in the approved form; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(f)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1972"},"content":[{"type":"text","text":"if the entity has a board, council or other governing body—is approved by the board, council or other governing body, as the case requires."}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-1973"},"content":[{"type":"text","text":"Civil penalty:"},{"type":"text","text":" "},{"type":"text","text":"150 penalty units."}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-1974"},"content":[{"type":"text","text":"A report given by an entity under subsection"},{"type":"text","text":" "},{"type":"text","text":"(2) is not admissible in evidence against the entity in civil proceedings relating to a contravention of a civil penalty provision of this Act."}]}]}]}]}]}
