or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2728"},"content":[{"type":"text","text":"is a system of national significance; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2729"},"content":[{"type":"text","text":"the Secretary believes on reasonable grounds that a relevant entity for the system of national significance would not be technically capable of preparing reports under section"},{"type":"text","text":" "},{"type":"text","text":"30DB or 30DC consisting of information that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2730"},"content":[{"type":"text","text":"relates to the operation of the computer; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2731"},"content":[{"type":"text","text":"may assist with determining whether a power under this Act should be exercised in relation to the system of national significance; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2732"},"content":[{"type":"text","text":"is not personal information (within the meaning of the "},{"type":"text","text":"Privacy Act 1988","marks":[{"type":"italic"}]},{"type":"text","text":")."}]}]}]}]}]}]}]},{"type":"heading","attrs":{"id":"v0-p-2733","level":6},"content":[{"type":"text","text":"Requirement","marks":[{"type":"italic"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2734"},"content":[{"type":"text","text":"The Secretary may, by written notice given to the entity, require the entity to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2735"},"content":[{"type":"text","text":"both:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2736"},"content":[{"type":"text","text":"install a specified computer program on the computer; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2737"},"content":[{"type":"text","text":"do so within the period specified in the notice; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2738"},"content":[{"type":"text","text":"maintain the computer program installed in accordance with paragraph"},{"type":"text","text":" "},{"type":"text","text":"(a); and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2739"},"content":[{"type":"text","text":"take all reasonable steps to ensure that the computer is continuously supplied with an internet carriage service that enables the computer program to function."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2740"},"content":[{"type":"text","text":"A notice under subsection"},{"type":"text","text":" "},{"type":"text","text":"(2) is to be known as a "},{"type":"text","text":"system information software notice","marks":[{"type":"bold"},{"type":"italic"}]},{"type":"text","text":"."}]}]},{"type":"legalListItem","attrs":{"marker":"(4)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2741"},"content":[{"type":"text","text":"In deciding whether to give a system information software notice to the entity, the Secretary must have regard to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2742"},"content":[{"type":"text","text":"the costs that are likely to be incurred by the entity in complying with the notice; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2743"},"content":[{"type":"text","text":"the reasonableness and proportionality of the requirements in the notice; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2744"},"content":[{"type":"text","text":"such other matters (if any) as the Secretary considers relevant."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(5)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2745"},"content":[{"type":"text","text":"A computer program may only be specified in a system information software notice if the purpose of the computer program is to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2746"},"content":[{"type":"text","text":"collect and record information that:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2747"},"content":[{"type":"text","text":"relates to the operation of the computer; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2748"},"content":[{"type":"text","text":"may assist with determining whether a power under this Act should be exercised in relation to the system of national significance;
