or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2824"},"content":[{"type":"text","text":"a telecommunications system;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-2825"},"content":[{"type":"text","text":"is likely to have a material adverse effect on the entity’s capacity to comply with its obligation under subsection"},{"type":"text","text":" "},{"type":"text","text":"30EB(2), to the extent that subsection applies for the purposes of security and the asset."}]},{"type":"paragraph","attrs":{"id":"v0-p-2826"},"content":[{"type":"text","text":"Note 1:"},{"type":"text","text":" "},{"type":"text","text":"For specification by class, see subsection"},{"type":"text","text":" "},{"type":"text","text":"13(3) of the "},{"type":"text","text":"Legislation Act 2003","marks":[{"type":"italic"}]},{"type":"text","text":"."}]},{"type":"paragraph","attrs":{"id":"v0-p-2827"},"content":[{"type":"text","text":"Note 2:"},{"type":"text","text":" "},{"type":"text","text":"See section"},{"type":"text","text":" "},{"type":"text","text":"30EE for the kinds of changes covered by this Division."}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2828"},"content":[{"type":"text","text":"As soon as reasonably practicable after becoming aware that the change, or proposed change, is likely to have a material adverse effect as mentioned in subsection"},{"type":"text","text":" "},{"type":"text","text":"(1), the responsible entity for the critical telecommunications asset must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2829"},"content":[{"type":"text","text":"notify the Secretary, in writing, of the change, or of the entity’s intention to implement the proposed change; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2830"},"content":[{"type":"text","text":"specify the asset in the notification; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2831"},"content":[{"type":"text","text":"include in the notification a description of the change or proposed change; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2832"},"content":[{"type":"text","text":"in relation to the change or proposed change—include in the notification any other information of a kind prescribed by the rules for the purposes of this paragraph."}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-2833"},"content":[{"type":"text","text":"Civil penalty:"},{"type":"text","text":" "},{"type":"text","text":"300 penalty units."}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2834"},"content":[{"type":"text","text":"Information of a kind prescribed by the rules for the purposes of paragraph"},{"type":"text","text":" "},{"type":"text","text":"(2)(d) must be information that relates to changes, or proposed changes, to telecommunications services or telecommunications systems."}]}]}]},{"type":"heading","attrs":{"id":"v0-p-2835","level":6},"content":[{"type":"text","text":"Further information","marks":[{"type":"italic"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(4)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2836"},"content":[{"type":"text","text":"If:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2837"},"content":[{"type":"text","text":"the responsible entity for a critical telecommunications asset gives a notification under subsection"},{"type":"text","text":" "},{"type":"text","text":"(2) in relation to a change or proposed change; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2838"},"content":[{"type":"text","text":"the Secretary considers that further information is required for the Secretary to assess whether, in relation to the change or proposed change, there is a risk to the asset that would be prejudicial to security;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-2839"},"content":[{"type":"text","text":"the Secretary may, by written notice given to the entity, require the entity to give the Secretary specified further information by the end of:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-2840"},"content":[{"type":"text","text":"44 business days after the day the notice is given;
