or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3124"},"content":[{"type":"text","text":"in writing."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3125"},"content":[{"type":"text","text":"The Minister must not give a Ministerial authorisation orally in relation to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3126"},"content":[{"type":"text","text":"an incident; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3127"},"content":[{"type":"text","text":"an asset;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3128"},"content":[{"type":"text","text":"unless the delay that would occur if the Ministerial authorisation were to be made in writing would frustrate the effectiveness of:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3129"},"content":[{"type":"text","text":"any directions that may be given under section"},{"type":"text","text":" "},{"type":"text","text":"35AK or 35AQ in relation to the incident and the asset; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3134"},"content":[{"type":"text","text":"an asset;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3135"},"content":[{"type":"text","text":"the Minister must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3136"},"content":[{"type":"text","text":"do both of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3137"},"content":[{"type":"text","text":"make a written record of the Ministerial authorisation;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3138"},"content":[{"type":"text","text":"give a copy of the written record of the Ministerial authorisation to the Secretary and the Inspector"},{"type":"text","text":"‑"},{"type":"text","text":"General of Intelligence and Security; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3142"},"content":[{"type":"text","text":"a critical infrastructure asset;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3143"},"content":[{"type":"text","text":"the Minister must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3144"},"content":[{"type":"text","text":"do both of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3145"},"content":[{"type":"text","text":"make a written record of the Ministerial authorisation;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3146"},"content":[{"type":"text","text":"give a copy of the written record of the Ministerial authorisation to the responsible entity for the asset; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3150"},"content":[{"type":"text","text":"a critical infrastructure sector asset (other than a critical infrastructure asset);"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3151"},"content":[{"type":"text","text":"the Minister must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3152"},"content":[{"type":"text","text":"make a written record of the Ministerial authorisation; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(d)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3153"},"content":[{"type":"text","text":"give a copy of the written record of the Ministerial authorisation to whichever of the following entities the Minister considers to be most relevant in relation to the Ministerial authorisation:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3154"},"content":[{"type":"text","text":"the owner, or each of the owners, of the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3155"},"content":[{"type":"text","text":"the operator, or each of the operators, of the asset;
