{"type":"doc","content":[{"type":"section","attrs":{"id":"navPoint_259"},"content":[{"type":"heading","attrs":{"id":"v0-p-3931","level":5},"content":[{"type":"text","text":"52B","marks":[{"type":"bold"}]},{"type":"text","text":"  ","marks":[{"type":"bold"}]},{"type":"text","text":"Declaration of systems of national significance by the Minister","marks":[{"type":"bold"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(1)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3932"},"content":[{"type":"text","text":"The Minister may, in writing, declare a particular asset to be a system of national significance if:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3933"},"content":[{"type":"text","text":"the asset is a critical infrastructure asset; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3934"},"content":[{"type":"text","text":"the Minister is satisfied that the asset is of national significance."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3935"},"content":[{"type":"text","text":"In determining whether an asset is of national significance for the purposes of subsection"},{"type":"text","text":" "},{"type":"text","text":"(1), the Minister must have regard to:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3936"},"content":[{"type":"text","text":"the consequences that would arise for:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3937"},"content":[{"type":"text","text":"the social or economic stability of Australia or its people; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3938"},"content":[{"type":"text","text":"the defence of Australia; or"}]}]},{"type":"legalListItem","attrs":{"marker":"(iii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3939"},"content":[{"type":"text","text":"national security;"}]}]}]},{"type":"paragraph","attrs":{"id":"v0-p-3940"},"content":[{"type":"text","text":" "},{"type":"text","text":" "},{"type":"text","text":"if a hazard were to occur that had a significant relevant impact on the asset; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3941"},"content":[{"type":"text","text":"if the Minister is aware of one or more interdependencies between the asset and one or more other critical infrastructure assets—the nature and extent of those interdependencies; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(c)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3942"},"content":[{"type":"text","text":"such other matters (if any) as the Minister considers relevant."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3943"},"content":[{"type":"text","text":"The Minister must notify the following of the declaration, in writing, within 30 days after making the declaration in relation to an asset:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3944"},"content":[{"type":"text","text":"the responsible entity for the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(aa)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3945"},"content":[{"type":"text","text":"the Parliamentary Joint Committee on Intelligence and Security;"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3946"},"content":[{"type":"text","text":"if the asset is a tangible asset located (wholly or partly) in a State, the Australian Capital Territory or the Northern Territory—the First Minister of the State, the Australian Capital Territory or the Northern Territory, as the case requires."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(4)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3947"},"content":[{"type":"text","text":"A declaration under subsection"},{"type":"text","text":" "},{"type":"text","text":"(1) is not a legislative instrument."}]}]},{"type":"legalListItem","attrs":{"marker":"(5)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3948"},"content":[{"type":"text","text":"To avoid doubt, an asset may be the subject of a declaration under subsection"},{"type":"text","text":" "},{"type":"text","text":"(1) even if the asset is not a system."}]}]}]}]}]}
