35AL  Form of direction

• (1)

  A direction under section 35AK may be given:

  • (a)

    orally; or

  • (b)

    in writing.

• (2)

  The Secretary must not give a direction under section 35AK orally unless the delay that would occur if the direction were to be given in writing would frustrate the effectiveness of the direction.

• (3)

  If a direction under section 35AK is given orally to an entity, the Secretary must:

  • (a)

    do both of the following:

    • (i)

      make a written record of the direction;

    • (ii)

      give a copy of the written record of the direction to the entity; and

  • (b)

    do so within 48 hours after the direction is given.
